Employment Law Counseling

At Martinez Law Group, P.C. (“MLG”), our goal is to ensure that our clients are comfortable with the legal and practical decisions they face in employment-related matters. We help them make informed decisions in the constantly changing landscape of employment law. As part of its employment law counseling services, MLG provides clients with thoughtful strategies for implementing preventative measures to avoid employment law claims. Because our attorneys are also experienced litigators, we have a broad, experienced perspective on the reasonableness, efficacy, costs and risks of various approaches.

We counsel clients on the substance of federal and state laws and regulations relating to employment matters, including those prohibiting discrimination, harassment, and retaliation; concerning leaves of absences; and governing wages.

Our expertise includes, for example:
    • advising on and crafting employment policies, forms, and handbooks;
     
    • drafting and reviewing employment-related documents, including offer letters, unconditional offers of reinstatement, employment (including executive) contracts, severance and/or separation agreements, releases, confidentiality and/or non-disclosure agreements, non-solicitation and/or non-competition agreements, independent contractor agreements, and arbitration agreements;
     
    • drafting pre-litigation correspondence (i.e., cease and desist communications) related to preserving proprietary, trade secret and confidential information and documents;
     
    • addressing employment performance issues;
     
    • providing guidance and advice relating to terminations and reductions in force; and
     
    • assisting with employee requests such as those for accommodation and leaves of absence.
